TERMS AND CONDITIONS
‘The Family Getaway Raffle’

GENERAL
- The Family Getaway Raffle (Raffle) is conducted by, and for the benefit of, the Back on Track Foundation of Unit 11, 100 Hay Street, Subiaco, Western Australia 6008 (Foundation, we, us or our).
- The Raffle is promoted in aid of the Foundation’s charitable causes. For more information about us or the Raffle more generally, please visit our website or contact us via one of the following methods:

- Our website can be accessed at the following link: www.backontrackraffles.com.au. The website will be maintained and accessible for the duration of the Promotion Period.
- By purchasing a ticket in the Raffle, you are deemed to have read and understood these terms and conditions (Terms) and have agreed to be bound by them.
- These Terms are subject to and must be read together with:
- any specific terms or conditions which (either expressly or impliedly) apply to the Raffle and have been notified to you in writing; and
- the laws of Western Australia, which apply to the conduct of the Raffle and the construction of any applicable terms.
- The Raffle is authorised by and conducted in accordance with the following state and/or territory approvals:
- WA Charitable Licence #CC23727; and
- WA Standard Lottery permit # LS222972925.

CONDITIONS OF ENTRY
- Promotion Period: Tickets in the Raffle are available for purchase from 9:00am Australian Western Standard Time (AWST) on 14/07/2025 until 9:00am AWST on 14/10/2025 (Promotion Period). No tickets will be sold outside of this timeframe.
- The Foundation may in its reasonable discretion seek approval from the relevant licensing authority to extend the Promotion Period prior to the commencement of the Promotion Period. In such circumstances, notice will be published on our website of any approved extension to the Promotion Period.
- We accept no responsibility for any attempts by a person to purchase a ticket in the Raffle which are not received during the Promotion Period for any reason whatsoever, including but not limited to, any lost, late, or misdirected entries. We also accept no responsibility for any technical difficulties which may arise in respect of the ticket ordering process and we do not warrant or guarantee that the ordering process will be available at all material times in respect of the Raffle.
- Eligibility: To be eligible to participate or purchase any ticket in the Raffle, you must be at least eighteen (18) years of age and you must be a resident of Western Australia. To avoid any doubt, residents of any other jurisdiction are not permitted to enter the Raffle and are not eligible to collect any prizes.
- Ineligible persons: The following persons and any members of their immediate family (defined as the person’s spouse (including de facto spouse), parents, children or a family member residing at the same premises as the person) are ineligible to purchase tickets for themselves or on behalf of any other person:
- a person directly engaged in the conduct of the Raffle including any members of the Management Committee of the Foundation; or
- an employee or office bearer of the Foundation or other benefitting organisation of the Raffle; or
- an internal auditor(s); or
- a person otherwise excluded by any relevant law, regulation or instrument from time to time.
- By purchasing a ticket in the Raffle, you warrant that you are not prohibited from accepting any of the Raffle prizes.
- By purchasing a ticket in the Raffle, you acknowledge and agree that:
- Raffle prizes are only transferable to the person named on the winning ticket;
- if you win and accept a prize, you consent to the publication of your initials and general geographic location being published on our website and a reasonable amount of publicity via our social media channels and email communications; and
- unless otherwise stated in these Terms, if you win and accept a prize that is not readily capable of delivery, you are solely responsible for the collection of the prize and any costs incurred in connection with such collection including any necessary travel to our office located at Unit 11, 100 Hay Street, Subiaco, Western Australia 6008 to claim a prize and the costs and expenses incurred in connection with any such travel.

TICKETS AND ENTRY LIMITS
- To enter the Raffle and be eligible to win a prize, you must complete the prescribed online entry form and purchase at least one ticket in the Raffle from the Foundation during the applicable Promotion Period and subject to any eligibility requirements set out in these Terms.
- The number of tickets available in the Raffle is 400,000. Each successfully purchased ticket in the Raffle will be included in the random draw process and has an equal chance of winning a prize.
- There is no cumulative maximum number of tickets that any one person may obtain (the Entry Limit). However, we reserve the right at any time to:
- introduce an Entry Limit; and/or
- limit the amount that any participant may spend (whether in aggregate, on a particular Raffle, or via a particular payment method) in a defined period or otherwise.
- The ticket pricing for the Raffle is structured as follows:
- Early Bird Special – Double Ticket Period: From 9:00am AWST on 14/07/2025 until 23:59 AWST on 28/07/2025 (Early Bird Period), customers receive double tickets for their purchase. During this period, $25 purchases ten (10) tickets.
- Standard Pricing: From 00:00 AWST on 29/07/2025 until 9:00am AWST on 14/10/2025 (Standard Period), tickets are available at the standard price of $5 per ticket. For the avoidance of doubt, all ticket purchases must be made within the applicable Promotion Period as set out in clause 1.1 of these Terms.
- A ticket in the Raffle that has been drawn will not be re-entered into the draw and is not eligible to be drawn multiple times.

DRAW AND PRIZE DETAILS
- The prizes for the Raffle are as follows (and will be drawn in the following order):
- First prize: 7 Nights in Bali – The Ultimate Family Escape (Total prize value: ~$13,500) Luxurious Bali getaway package at ‘Villa Mystique’, Jalan Pura Telaga Waja, Seminyak (Bali), Indonesia (Villa) operated by Geri Farr (Villa Owner). Prize includes:
- Accommodation: exclusive use of a private villa located at the Villa for seven (7) consecutive nights (eight (8) consecutive days) for a maximum of two (2) adults (aged over 18 years old) and two (2) children;
- Flights: return economy class flights from Perth International Airport to Denpasar International Airport, Bali, Indonesia for up to two (2) adults (aged over 18 years old) and two (2) children (costs of transport to and from Perth International Airport not included);
- Transport: unlimited private transport with a personal driver as chosen at the Foundation’s discretion during your period of stay;
- Family pass to Waterbomb Bali water park: a family pass (four pack pass) to the Waterbomb Bali water park located at Jl. Kartika Plaza Tuban Kuta, Bali, Indonesia; and
- Spending money: $5,000 in spending money.Prize must be redeemed by the prize winner within twelve (12) months of the Draw Date and the prize winner must provide at least thirty (30) days’ written notice to the Villa Owner of their intended stay dates. Bookings at the Villa are subject to availability and the Villa Owner’s terms and conditions (available here: https://villa-mystique.hotelsseminyak.net/en/). Tickets to the Waterbomb Bali water park are subject to the operator’s terms and conditions and availability. If the Villa and/or access to the Waterbomb Bali water park becomes unavailable due to unforeseen circumstances (for example, without limitation, a natural disaster, government restrictions or pandemic), the Foundation reserves the right (subject to applicable laws) to provide a substitute prize of equal or greater retail value including but not limited to a financial equivalent.For further details and conditions applying to the prize including all inclusions, amenities and features of the Villa, please see https://villa-mystique.hotelsseminyak.net/en/.
- Second prize: 7 Nights in Bali at FuramaXclusive Ocean Beach Seminyak (Total prize value:~$7,300) Bali getaway package at ‘FuramaXclusive Ocean Beach’, Seminyak (Property) operated by Lyndon Hollings (Property Owner). Prize includes:
- Accommodation: exclusive use of a self-contained 2-bedroom apartment at the Property for seven (7) consecutive nights (eight (8) consecutive days) for a maximum of two (2) adults (aged over 18 years old) and two (2) children;
- Flights: return economy class flights from Perth International Airport to Denpasar International Airport, Bali, Indonesia for up to two (2) adults (aged over 18 years old) and two (2) children (costs of transport to and from Perth International Airport not included);
- Transport: unlimited private transport with a personal driver as chosen at the Foundation’s discretion during your period of stay;
- Family pass to the Bali Wake Park: a family pass to the Bali Wake Park located at Jl. Raya Pelabuhan Benoa No.7X, Denpasar, Bali, Indonesia; and
- Spending money : $1,500 in spending money.Prize must be redeemed by the prize winner within twelve (12) months of the Draw Date and the prize winner must provide at least thirty (30) days’ written notice to the Property Owner of their intended stay dates. Bookings at the Property are subject to availability and the Property Owner’s terms and conditions (available here: https://www.furama.com/terms). Tickets to the Bali Wake Park are subject to the operator’s terms and conditions and availability. If the Property and/or access to the Bali Wake Park becomes unavailable due to unforeseen circumstances (for example, without limitation, a natural disaster, government restrictions or pandemic), the Foundation reserves the right (subject to applicable laws) to provide a substitute prize of equal or greater retail value including but not limited to a financial equivalent.For further details and conditions applying to the prize including all inclusions, amenities and features of the Property, please see https://www.furama.com/terms .
- Third prize: 6 Nights at Bunker Bay Resort (Total prize value: ~$6,000): Luxury stay at the renowned ‘Pullman Bunker Bay Resort’ in Western Australia (Resort). Prize includes:
- Accommodation: exclusive use of a studio villa at the Resort for six (6) consecutive nights (seven (7) consecutive days) for a maximum of two (2) adults aged over 18 years;
- Dining: Daily breakfast for two adults at the Resort’s award-winning restaurant; and
- Spending money: $1,000 in spending money.Prize must be redeemed by the prize winner within twelve (12) months of the Draw Date and the prize winner must provide at least thirty (30) days’ written notice to the operator of the Resort of their intended stay dates. Bookings at the Resort are subject to availability and the terms and conditions of the operator of the Resort (available here). - Fourth Prize: Cable Beach Club Resort & Spa Getaway (Total prize value: ~$4,000)The fourth prize is a luxury escape for two adults at the iconic Cable Beach Club Resort & Spa in Broome, Western Australia. The prize includes three consecutive nights’ accommodation in a Garden View Studio, daily breakfast for two at the Resort, return economy airfares for two adults from Perth to Broome and $1,000 in spending money.The prize must be redeemed by 31 December 2026, and bookings are subject to availability (exclusions apply during Broome Cup week). The winner must provide at least thirty (30) days’ written notice to the Resort to secure their preferred stay dates. The full prize value must be redeemed in a single booking; no cash alternatives or partial redemptions are permitted. - Fifth prize: 3 Nights at ‘Serenity Gully’ Luxury Adult Glamping Accommodation (Total prize value: ~$2,855): Prize includes a voucher redeemable for a mid-week stay of three (3) consecutive nights (four (4) conseuctive days) at Serenity Gully Bridgetown (Serenity Gully). Stay must be booked for a period between Sunday and Friday of any given week (i.e. mid-week). Prize also includes an early 1pm check-in bottle of Venditti wine and $1,000 in spending money. Prize must be redeemed by the prize winner within twelve (12) months of the Draw Date and the prize winner must provide at least thirty (30) days’ written notice to the operator of Serenity Gully of their intended stay dates. Bookings are subject to availability and Serenity Gully’s terms and conditions (available here: https://www.serenitygully.com.au/team/booking-terms-%26-conditions). If staying at Serenity Gully becomes unavailable due to unforeseen circumstances (for example, without limitation, a natural disaster, government restrictions or pandemic), the Foundation reserves the right (subject to applicable laws) to provide a substitute prize of equal or greater retail value including but not limited to a financial equivalent.
- Sixth prize: 2 Nights at Novotel Perth Murray Street (Total prize value: ~$1,000): Stay package at the Novotel Perth Murray Street (Novotel). Prize includes:
- Accommodation: exclusive use of modern family suite at the Novotel for two (2) consecutive nights (three (3) consecutive days) for a maximum of two (2) adults (aged over 18 years old) and two (2) children;
- Family cinema tickets: a family platinum ticket pass to Palace Cinemas, Raine Square, 300 Murray Street, Perth, Western Australia; and
- Spending money: $500 in spending money.Prize must be redeemed by the prize winner within twelve (12) months of the Draw Date and the prize winner must provide at least thirty (30) days’ written notice to the Novotel operator of their intended stay dates. Tickets to the Palace Cinemas are subject to the operator’s terms and conditions and availability. - First prize: 7 Nights in Bali – The Ultimate Family Escape (Total prize value: ~$13,500) Luxurious Bali getaway package at ‘Villa Mystique’, Jalan Pura Telaga Waja, Seminyak (Bali), Indonesia (Villa) operated by Geri Farr (Villa Owner). Prize includes:
- Draw Date: Unless otherwise notified in writing prior (whether by email to you or by notice published on our website), the draw of all eligible entries received during the Promotion Period will take place using a certified random number generator at 16:00 AWST on 15/10/2025 (Draw Date) at 100 Hays Street, Subiaco, Western Australia or remotely.
- We reserve the right to disqualify any person who has purchased a ticket(s) in the Raffle if, in our reasonable opinion, the person has breached any clause of these Terms or any other terms applicable to the Raffle or if the person has otherwise engaged in any unlawful or other improper conduct in connection with their participation in the Raffle (in the reasonable opinion of the Foundation) or any conduct which is assessed by the Foundation, acting reasonably, to be contrary to the integrity or fair and proper conduct of the Raffle. By purchasing a ticket in the Raffle, you acknowledge and agree that such a decision by us is final and binding.
- We also reserve the right, at any time, and in our sole discretion to:
- require any person who has purchased a ticket in the Raffle to provide proof of identity and/or proof of purchase of a valid ticket; or
- verify the validity of a ticket.
- Notification and publication of prize winners: We will notify prize winners (each a Potential Winner) within three (3) business days after the Draw Date either by email, phone or registered post at our discretion and using the contact details disclosed by the prize winner when entering the Raffle. Results will also be published on our website (accessible at backontrackraffles.com.au) including the initials and geographical location of prize winners and in the West Australian newspaper. Potential Winners are encouraged to respond promptly to the notification from us to enable timely delivery of prizes and administration of the Raffle. Potential Winners are subject to confirmation and verification by us in accordance with these Terms. Once confirmed and verified as eligible to win, a Potential Winner is referred to herein as a “Winner”.
- By accepting and collecting a Raffle prize, the Winner acknowledges that they are responsible for the costs associated with (as applicable) arranging insurance, transfer of registration and any liabilities arising after receipt of the prize. We may, in our reasonable discretion, pay for the costs of rectifying any proven defects in prizes provided that such defects are notified to us in writing no later than three (3) months after the Draw Date. To avoid any doubt, we do not accept responsibility for any damage (including any general ‘wear and tear’) to prizes caused by a Winner or their agents whatsoever.
- Unclaimed prizes: If a prize is won by an eligible participant, the Potential Winner will have twelve (12) months from the Draw Date to claim their respective prize. If a prize remains unclaimed after that period has expired, we will deal with the unclaimed prize in accordance with the Gaming and Wagering Commission Act 1987 (WA) and its subordinate legislation. For example, we may notify the Western Australian regulator of the following details in respect of any unclaimed prize:
- the Potential Winner’s name and any known address;
- details of the prize(s) which remains unclaimed; and
- details of the steps we have taken to locate and find the Potential Winner.In such circumstances, you acknowledge that we are then bound to comply with any direction(s) issued to us by the Western Australian regulator, including any direction requiring a prize to be sold or otherwise dealt with.
- The right to a prize cannot be assigned nor can a prize be transferred or exchanged. Images used to portray any prize are for display purposes only and may not depict exact prize details.
- Non-cash prizes are not redeemable for cash. All costs, expenses, taxes, levies and imposts associated with the prizes not specifically referred to as being the responsibility of us are the responsibility of the relevant prize winner.
- If we are unable to provide a Winner with a nominated prize, or the Winner is unable to legally own or receive the nominated prize, we reserve the right to substitute the nominated prize with another prize of commensurate value in our absolute discretion and subject to any approval required from the Western Australia regulator or any applicable laws.
- The prizes for the Raffle are as follows (and will be drawn in the following order):

VERIFICATION OF POTENTIAL WINNERS
- A Potential Winner will only be confirmed as a Winner eligible to receive their respective prize(s) after the Foundation has completed satisfactory verification of the Potential Winner’s eligibility to win and has confirmed the Potential Winner’s compliance with these Terms. The Potential Winner must be willing and able to claim and/or accept the Prize(s) in full in the period specified by the Foundation (which will be no less than 12 months). Potential Winners are subject to confirmation and verification by the Foundation, by whatever reasonable means required by the Foundation.
- To be confirmed and verified as eligible to win a prize(s), a Potential Winner and the Potential Winner’s guest(s), if applicable, must comply with these Terms and any other terms or conditions applicable to the Raffle. Subject to any applicable laws, the Foundation’s decisions are final and binding in all matters related to the administration, operating, drawing, verification of the Potential Winner, and all issues related to the drawing of prizes.
- Without limiting any other clause of these Terms, the following information may be required to be produced to the Foundation from any Potential Winner for the purposes of verification:
- Winner Materials: To receive the prize(s), the Potential Winner (and any guests of the Potential Winner, to the extent that a prize includes any participation by one or more guests) must accurately complete and promptly return any legal releases or documentation (for instance, if the prize involves attendance at an event and/or travel, health and safety forms, including any vaccination attestations, including, providing proof of the same in a format determined in the Foundation’s reasonable discretion) reasonably required by the Foundation or the provider of the prize(s) (where permitted by law) and/or any other document necessary to confirm and verify a Potential Winner’s eligibility and ability to participate on given dates relevant to any drawing of a prize (if applicable) (collectively the Winner Materials). The Potential Winner must fully and accurately complete the Winner Materials and return all such information within a reasonable period of time as specified by the Foundation. Failure to do so may result in the Potential Winner being disqualified and forfeiting any claim to any of the prize(s).
- Background Checks: Subject to any applicable laws, the Foundation reserves the right to conduct background screenings or security checks, at its discretion, on a Potential Winner (and any Potential Winner’s guests, where applicable). The Potential Winner agrees to sign any necessary documentation required for such checks or otherwise provide their consent to such checks occurring. Any checks undertaken under this section will be done in accordance with the Foundation’s Privacy Policy. The Foundation reserves the right to disqualify any Potential Winner and any Potential Winner’s guest(s) (if applicable) based on the results of such background or security checks (or the background check of Potential Winner’s guest(s), if applicable), if the Foundation reasonably determines that awarding the prize(s) to such Potential Winner and/or Potential Winner’s guest(s) would either:
- contravene any applicable law or regulation; or
- be likely to put the Foundation (or any other third-party) in danger.
- Without prejudice to any other rights or remedies available to it, the Foundation reserves the right to withhold, reassign, or otherwise refuse the awarding of any prize (subject to applicable laws) if doing so may, in its reasonable opinion, adversely affect, damage or impact the Foundation’s reputation, goodwill or public image. This includes, but is not limited to, instances where a prize is won by an individual or entity whose background, conduct and/or affiliations are deemed inconsistent with the Foundation’s values or objects, or could be reasonably perceived to undermine the integrity of the Foundation and/or Raffle. By entering the Raffle, all participants agree that the Foundation’s decision not to award a prize in accordance with this clause is final and binding.
- Unless legally required, the Foundation is not obligated to clarify, confirm, or share any specific results of a background screening or security check with any Potential Winner or any Potential Winner’s guest(s), whether the background screening or security check resulted in disqualification or not. When requested, the Potential Winner and their guest(s) (if applicable) must provide authorisations and/or complete any forms reasonably needed to facilitate such a background screening or security check. If the Potential Winner and/or Potential Winner’s guest(s) fails to sign and return the required documentation within the period specified by Promoter or fails to give the requested authorisations, the Potential Winner and/or Potential Winner’s guest(s) may be disqualified and may forfeit any claim to any of the prize(s).

RESOLUTION OF DISPUTES
- These Terms shall be governed and construed in accordance with the laws of Western Australia. By participating in the Raffle, you irrevocably agree to submit to the non-exclusive jurisdiction of the Western Australian courts in respect of any dispute arising out of or relating to these Terms or concerning the conduct of the Raffle or claiming any prize (Dispute).
- As a first point of reference, you should direct any Dispute to the Foundation’s customer service team by emailing: [email protected]. The Foundation is committed to providing world class customer service, and to dealing with any Disputes that may arise in a prompt, fair, and efficient manner. The Foundation will endeavour to provide its response to a Dispute raised under these Terms within 21 days, unless the Dispute has been escalated to a court of competent jurisdiction prior. The Foundation may require additional information from you to enable it to properly resolve your Dispute. If this applies, you will be contacted and requested to provide the necessary additional information.
- If any Dispute cannot be resolved between you and the Foundation, the Dispute may be determined by a Western Australian court or tribunal (as the case may be) of competent jurisdiction.

DISCLAIMERS
- No donor or provider of a prize in the Raffle is a promoter of the Raffle.
- Any product or brand names, logos, images, and other trademarks featured or referred to on our website or promotional material related to the Raffle are the property of their respective trademark owners. We do not represent an affiliation with any trademark owner referenced on our website or promotional materials. Unless otherwise stated, the trademark owners do not sponsor, approve, or endorse the Foundation.
- All Raffle prizes are valued by us at the retail price (including GST) recommended by the relevant manufacturers, donor organisations and/or suppliers.
- Whilst we try our best to ensure that any information we publish in relation to Raffle prizes is true and correct, we do not warrant its accuracy or completeness and we do not take any responsibility for any inaccuracies, omissions, variations, or errors in the information we provide. Any photographs, props or illustrations are for marketing and promotional purposes only and do not necessarily depict precise nature or detail of prizes. Any person who wishes to rely on any information regarding any Raffle prizes should make their own enquiries to satisfy themselves as to its accuracy and correctness and how it may apply to them. Photographs and floor plans are for illustrative purposes only and may not be to scale or depict exact prize detail or size.
- By purchasing a ticket in the Raffle, you acknowledge and agree that:
- we may collect, use and disclose the information you provide on the terms and for the purposes (including promotional or marketing materials) set out in our Privacy Policy available on our website and accessible here: https://backontrack.org.au/privacy/; and
- we are permitted to contact you before or after the Raffle unless you advise us that you do not wish to be contacted.
- To the extent permitted by law including under the Australian Consumer Law (schedule 2 of the Competition and Consumer Act 2010 (Cth)), we will not be liable for any loss or damage of any nature and however caused to any person in relation to, or in connection with, the Raffle including but not limited to any direct, indirect or consequential loss or damage, or personal injury. To avoid any doubt, we will not be liable to any person who wins a Raffle prize and suffers any subsequent financial loss or consequences including but not limited to any:
- taxation liabilities or levies that may accrue to the winner; and
- detriment suffered in relation to any pension, benefit allowance, superannuation or similar entitlement.
- If the Foundation is prevented from or delayed in performing an obligation by Force Majeure then, subject to applicable law, the obligation is suspended during, but for no longer than, the period that the Force Majeure continues and any further period that is reasonable in the circumstances. “Force Majeure” means an event beyond the reasonable control of the Foundation, which occurs without the fault or negligence of the Foundation.
- The Foundation reserves the right to cancel any draw at any time for any reason subject to any applicable laws.
- All third-party names and trademarks are the property of their respective owners. This Raffle is not sponsored, endorsed, or affiliated in any way with Trayd Australia, FuramaXclusive Ocean Beach, Bunker Bay Resort, Serenity Gully, and Novotel, or any of their respective affiliates.
- The Foundation does not make any representations or warranties as to the quality, suitability or merchantability of any goods or services offered in connection with the Raffle. RESPONSBILE GAMBLING
- The Foundation encourages all participants in our Raffle to play responsibly, have fun and only spend within their financial means. For information on playing responsibly, please call the Gambling Hotline on 1800 858 858 or visit gamblinghelponline.org.au.
- Any Raffle tickets purchased using a credit card are final and not disputable. However, if a person who purchases a ticket believes that they have a gambling problem or are overextended financially, they will be given an opportunity to amend or cancel their ticket purchase by contacting us by email at [email protected] or by phone on 08 9363 7400.

- Pursuant to the Privacy Act 1988 (Cth), your personal information may only be stored, accessed, used, or disclosed internationally where such actions are done so in accordance with the Privacy Act, our Privacy Policy, and Australian law. We will collect your personal information to facilitate the purchase of your ticket in the Raffle and may also use your personal information for any other purposes set out in these Terms or to contact you about other activities and services of the Foundation. If a purchaser of a ticket does not wish to be contacted about other activities and services of the Foundation, they may opt out of such communications at any time by sending us an email at the following address: [email protected].
